Should my aunt sue the school?

Two weeks ago my 10-year-old cousin was accidentally kicked in the head by his clmate while his clmate was swinging on the swings during recess. He happened to be in her way but didn't know didn't know he was in her way. She apologized but then my cousin complained of headaches. So his teacher send him to the nurse's office and the nurse sent him back to cl with an ice pack. Then the headache got worse and his teacher sent him back to the nurse's office and she called his mom to come pick him up. Then as soon as my aunt came to the school, my cousin collapsed on the floor at the school. Then the paramedics came to take my cousin to the hospital and my aunt told us that the paramedic even asked the nurse how come she didn't called them first and the nurse didn't say nothing. My cousin suffers from short term memory loss and now my aunt is thinking about suing the school for how they handled my cousin's injury.Now my cousin is improving. What do you guys think?
